The Health Insurance and Portability and Accountability Act (HIPAA) of 1996 requires standards for protecting the privacy of medical and health information. It is referred to as Protected Health Information (PHI). PHI is information maintained by healthcare entities including hospitals, pharmacies, health plans, dental practices and private physician practices.
Compliance begins April 14, 2003 with smaller health plans (having less than $5 million in annual receipts) having until April 14, 2004. There are civil and criminal penalties that have been established if covered entities violate patient's rights. Under HIPAA, patients are given fundamental rights including:
- the right to inspect and/or obtain copies the their medical records
- the right to request amendments to their record
- the right to request restrictions on the disclosure of their protected health information
- the right to ask practices to communitcate with them in a certain manner
- the right to ask practices for a log of who has accessed their protected health information
